The Isidore Leroy brand belongs to S.A. CII Participations, 19 rue Commandant Cousteau 33100 Bordeaux, also referred to hereinafter as "Isidore Leroy" or "the seller".
The seller has set up a website for the sale of decorative products to which the General Terms and Conditions of Sale (GTCS) apply, for the sale to natural persons (hereinafter referred to as "private customers") and to professional customers (hereinafter referred to as "professionals").
Placing an order implies acceptance of these General Terms and Conditions of Sale.
The seller may, at its discretion, modify the General Terms and Conditions of Sale, but all orders placed under the previous terms and conditions shall be governed by them.


Products
Each product is presented with its technical characteristics and under a unique reference.
Photos are subject to change at the discretion of the Company. The colours in the photos are not contractual and may not correspond to the samples sent. The Company cannot be held responsible for these differences due to the quality of the screens or the different baths of the products.


Orders
Each order shall be subject to acceptance of the general terms and conditions of sale.
To be valid, an order must be paid in full, in advance by means of one of the various solutions offered online or by cheque. And correctly filled in the form displayed on the site, the buyer must provide a valid billing and delivery address, an email and telephone number. Order confirmations are sent by e-mail to the address indicated by the customer in his order.
The date of the order is the validation date.
All orders placed on the weekend (Friday 12:00 to Monday 9:00) will be validated on Tuesday at the latest. All orders received in the morning and validated will be processed within 48 hours for the shortest possible delivery time.
Orders can be cancelled by contacting our customer service department until the products are dispatched, with the exception of personalised products for which, in the event of cancellation of the order by the customer, an indemnity equal to or greater than 50% will be retained, which will be increased to 100% of the price if the products have been specially manufactured for the customer.
In the case of a cancellation with partial refund, the refund will be made within one month after the seller has accepted the cancellation.


Delivery
The seller shall not be held responsible for a wrong delivery address indicated by the Customer.
In this case, after a period of 3 months, the products will be put back on sale and the payment retained by the seller.
Products returned to the seller due to a delivery error or absence of the recipient will be reshipped at the customer's sole expense.
Delivery times are indicated for each product on the product sheet. They are normally 7 working days but may be longer for certain references. It is advisable to add between 2 and 4 working days for deliveries to DOM/TOM and countries outside the euro zone. This period is indicated in the order confirmation.


Returns
Isidore Leroy offers private customers a right of return or retraction of 15 days. Individual customers have fifteen days from the date of delivery of their order to return the product to the seller for exchange or reimbursement without penalty, except for the cost of return.
This possibility does not apply to customised products made specifically for a customer.
The return shipping costs will be charged to the customer.



Warranty - Claims

All products supplied by the seller benefit from the legal guarantee of twelve months provided for by articles 1641 and following of the Civil Code.
All returns must be made by email to the following address contact@isidoreleroy.com

In the case of references received but not ordered, after verification that the error is not attributable to the customer, the products will be returned by the customer at the seller's expense.
Failure of the Goods to arrive must be reported to the Seller within 15 days of the date of the order confirmation.
On receipt of the order the customer must :


(a ) Check that the quantity of Goods received is correct;

 

(b) After laying 2 or 3 lengths on the floor, inspect the result to ensure that no defects are present. No claims for laying costs can be accepted once more than one roll has been laid.

(c) In the event of any discrepancy, the Customer shall notify the Seller within 7 days of the arrival of the Goods and before any processing of the Goods.

(d) Unwanted products must be returned in their original packaging, undamaged and in a saleable condition. Once the product is received at Isidore Leroy, we will contact the customer to arrange a refund.


Any problem not apparent on reasonable initial inspection must be reported to the Seller within 5 days of discovery. After this period, no liability will be accepted in this respect.


Shipping error

In the case of a delivery of products that do not correspond in quantity to the order form, the remainder of the order will be sent to the customer at the seller's expense.
In the case of delivery of references different from those ordered, the products will be returned at the seller's expense.


Transport damage
Upon delivery, the customer or his representative must inspect the goods in the presence of the duly authorised carrier. In the event of damage due to transport, the customer, in his capacity as recipient, must expressly notify the reservations to be made within the time limits set by the carrier, and send a copy to the seller who reserves the right to refuse the return, reimbursement or replacement of the products.

Guarantee of conformity
In the event of non-conformity of a product sold, it may be returned to the seller who will take it back, exchange it or refund it.
No complaint can be received concerning a difference in colour shade between several manufacturing baths if the buyer has placed several separate orders.

Limitation of Liability
The seller's liability is strictly limited to the value of the goods found to be non-conforming, defective or faulty, without compensation of any kind and for any reason whatsoever.



Protection of personal data
In accordance with the law relating to data processing, files and freedoms of January 6, 1978, information of a personal nature relating to the purchasers could be the subject of an automated treatment.

The seller may collect information on buyers using the means available on the Internet, e.g. cookies, and transmit the information to its commercial partners if it so wishes.

However, customers may request that their personal information not be communicated and have the right to access and rectify information in accordance with the law of 6 January 1978.
Intellectual Property

The Seller's designs, patterns and images (including photographs of room settings, images of fabrics, lampshades, pouches, kits and scans of patterns) are the property of the Seller.
Any use of the Seller's designs and images (including photographs of room settings, images of fabrics and scans of patterns), trademarks, logos, copyright and other intellectual property rights must be authorized in writing by the Seller, which may be withdrawn at any time at the Seller's discretion.
Any use of the products for framing purposes or in the form of a painting is prohibited.


Litigation

In accordance with the law relating to data processing, files and freedoms of 6 January 1978, information of a personal nature relating to purchasers may be subject to automated processing.

We only collect personal information about the user (name, e-mail address, telephone number) for the purposes of the electronic transaction, statistical processing or commercial follow-up. The user provides this information with full knowledge of the facts, in particular when he/she enters it himself/herself. The information collected is therefore not transmitted to any third party.

However, buyers may request that their personal information not be communicated and have the right to access and rectify information in accordance with the law of 6 January 1978.


The present conditions of online sale are subject to French law. The courts of Bordeaux have exclusive jurisdiction for all disputes.
